Sub: - Submergence of residential colonies at Gulshan Nagar Bypass Road, Nowgam Srinagar by the drains being constructed through J&K ERA under ADB funded   Multi-Sector Project for Infrastructure Rehabilitation.

 

Sir,

We the residents of Gulshan Nagar Bypass Road, Srinagar and the adjacent residential localities have been marooned by the drainage water from recently constructed drains from Chanapora, Lalnagar to Gulshan Nagar. The construction work of drains is being executed through J&K ERA under ADB funded Multi-Sector project for infrastructure rehabilitation programme (Sub-Project National Highway Bypass from Pohru chowk to Chanapora bridge).

In this context, it is submitted that the implementation of this programme has to ensure public interest and provide relief to the general public, which is not the case in respect of these two RCC/Pipe drains which have carried drainage water towards the residential colonies of Gulshan Nagar instead of the legitimate outfall into Doodhganga Nallah.

As such it is submitted for redressal of our grievances as under:

1.   That our residential area has been submerged and marooned by the diversion of drainage water of entire catchment area through the recently constructed drains from Chanapora bridge to Gulshan Nagar. Besides dewatering during execution of Lalnagar Methen drain and disposing same into the Bypass drain, compounding the adversity.

2.   That due to this condition, the life and property of the residents face a grave risk.

3.   That the sanitation of the area has collapsed and residents forced to migrate due to submergence of the residential colonies.

4.   That the Executive Agency has made no arrangements for proper disposal of the drainage water, leaving the residents at the mercy of the Almighty.

5.   That the locality had a drainage system in place with a proper dewatering station and disposal of drainage water into Doodhganga Nallah through steel piping system which got dismantled during widening of the Bypass road.

6.   That a writ petition is already pending in the Hon’ble High court for restoring the dewatering system, which has not been restored so far and instead problem has been aggravated by newly constructed drains.

7.   That the residents have fundamental right to seek justice and compensation for the loss being suffered due to Executive Agency’s negligent approach to address the ground realities of public interest.

As such it is requested that the dewatering station of the locality be restored along with piping arrangement with outfall into Doodhganga Nallah, which is the only effective system of drainage disposal in the locality and the construction work of drains from Chanapora and Lalnagar be suspended till proper disposal arrangements are made by the Executive Agency.

Thank you for suggesting the line of action for redressing the complaints. In this regard I have already initiated the following actions:
  1. Joint inspections by ERA and DSC engineers with complainants have been conducted. Even I have also visited the area on 12-05-2010 and met the complainants. Instructions have been passed to the ERA/DSC/Contractor to expedite road restoration immediately after the weather improves.
  2. The representatives of the areas have been invited to attend the ERA office wherein they will be briefed about all details of the projects.
  3. ERA/DSC/Contractor have been instructed to take precautionary measures during execution.

The  point wise report on the complaint of Gulshan nagar as furnished by the Engineer of the project is attached.
Note for PM urban and DSC-II:
  • As advised from time to time n on 12-05-2010 at site, pl formalise public grievance redressal system in ur offices. 
  • Take utmost care in execution of the works, safeguarding the public property and ensure bare minimum inconvenience (unavoidable) to the public.
  • Be polite in understanding the grievances and take immediate action for their redressal.
  • Expedite the progress of work.

We are receiving number of complains regarding the drainage contracts in Srinagar. We request you to take following approach to address these grievances:

1) Have joint inspection with the complainants at each of the sites.

2) Arrange meetings with the representatives of these organizations (Resident welfare committees,   CBOs, NGO etc). In the meeting brief them about the scope of work ERA is executing, understand the grievances of the complainants, prepare an action plan to redress those grievances; and prepare and circulate minutes of those meetings to the complainants with a copy to ADB

3) Advise your Project Manager (Urban), DSC (Urban-Srinagar) and contractors  to take utmost precaution during execution of works, to avoid repetition of similar incidents.

4) Update the resident committees/ CBOs regularly on the actions ERA is taking to redress the grievances.

5) Document the consultations and information sharing exercise carried out by ERA with the beneficiaries

6) Improve the information sharing and public consultation activities around specific works and project beneficiaries with stress on inconvenience caused by construction activities and delays.

7) Formalize the public grievance redressal system of the Project

8) Hold more meetings with the complainants and media

Sub.: Construction of Deep Drain is not showing standard
quality.


Sir,

Respectfully I on behalf of the Welfare Committee concerned
area where the Construction of Deep Drain is under progress from Masjid
Ahlihadis Methan going up to Gulshan Nagar Byepass, want to know about
the detailed estimate with item wise specifications as the work going
on construction of deep drain is not showing standard quality.

The pipes are being laid on plain surface without concreting or
preparation of plate form for safeguarding the floor area of the Pipes
as well as the jointing of pipes are being tackled on unhygienic
system, so there remains every apprehensions that due to heavy loading
of traffic as well as natural calamity, lest the pipes, with the
passage of time may submerge any time.
There is no Engineer on site while laying pipes who guides them
by way of proper work as per specifications. It unfortunate that huge
public amount is being burden under soil for no purpose. If your good
self will not take an immediate action we are bound to go to vigilance
& other enquiry agencies.
It is therefore requested to kindly provide us the documents at
an earliest so that we may not be compelled to get the same into the
notice of concerned Ministry as well as Vigilance Commissioner.
