Appeal to Honble CM

We the residents of Gulshan Nagar Bypass Srinagar and the adjacent residential localities have been marooned by the draianage wter from recently constructed drains from Chanapora, Lal Nagar to Gulshan Nagar. The construction work of drains is being executed through JK ERA under ABD funded MultiSector project for infrastructure rehabilitation programme (SubProject National Highway Bypass from Pohru to Chanapora Bridge).
in this context, it is submitted that the implementation of this programme has to ensure public interest and provide relief to general public, which is not the case in respect of these two RCCPipe drains which have carried drainage water towards the residential colonies of Gulshan Nangar instead of the legitimate outfall into Doodhganga Nallah.
As such it is submitted for residential of our grievencies as under:
1. That our residential area has been submerged and marooned by the diversion of drianage water of entire cathmet area through the recently constructed drains from Chanapora Bridge to Gulshan Nagar. Besifes dewatering execution of Lal Nagar Methan drain and disposing same into Bypass drain, compundiung the adversity.
2. That due to this condition, the life and property of the residents face grave risk.
3. That the sanitation of the area has collapsed abd residents forced to migrate due to submergence of the residential colonies.
4. That the Executing Agency has made no arrangaments for proper disposal of the drainage water, leaving the residents at the mery of All Mighty Allah.
5. That the locality had a draiange system in place with a proper dewatering station and disposal of draiange water into Doodhganga Nallah through steel piping sysem which got dismantled during widening of the Bypass Road.
6. That a Writ Petition is already pending in the Honble High Court for restoring the dewatering system, which has not been restored so far and instead problem has been aggravated by newly constructed drains.
7. That the residents have fundamental right to sek justice and compensation for the loss being suffered due to Executive Agencys negigent approach to address the ground realities of public interest.
As such it is requested that the dewatering station of the loaclity be restored along with piping arrangement with outfall into doodhganga Nallah, which is the only effective system of drainage disposal in the locality and the construction work of drains from Chanapora and Lal Nagar be suspended till proper disposal arrangements are made by the EXecutive Agency.

Residents of gulshan Nagar Colony

Disposal The point wise reply to the application of residents of Gulshan Nagar Colony is as under:

1. It is not correct that the area in question has been submerged and marooned by the diversion of drainage water of entire catchment area through the recently constructed drains from Chanapora Bridge to Gulshan Nagar. The area in question is low lying area and gets submerged due to rains always. Further, it is to point out here that by constructing drain along National Highway Byepass by JK ERA has not caused any sub mergence of the area.

23. As per S.No. 1 above.

4. The work of construction of drainage system of the area is under execution. As such, proper drainage of the area is possible only after completion and commissioning of the project.

5. The existing drainage system of the area is under the control of the line department in the said area which has no proper outlet at present. Infact, it has been observed that the rain water collected from the area enters into the Manhole near the N.H. Byepass under the control of the line department and from there the Emergency and Fire ServicesUEED Department drains out water of the area in question through pumps with canvas delivery pipe into the Doodhganga Nallah.




Widening of N.H. Byepass road took lace before ERA had started the work. As such ERA has no knowledge of dismantling of the disposal of drainage water steel pipe system.

6. Statement of facts is being submitted before the Hon’ble High Court.

7. There is no such negligence from the ERA side. The existing drainage system near Byepass shall be connected with the Drainage Network of National Highway Byepass at the time of completion and commissioning of the scheme.
