The contract awarded by ERA was originally through outside state consultant who are very highly paid drawing very high salaries from J&K ERA had not evaluated the actual work to be executed at the site and material to be procured at their sources resulting in issuing of unprofessional contracts .Even Contract documents are prepared by people not well experienced and qualified for hill  road to evaluate the overall BOQ quantities and actual nature/item of work involved for the completion of project.Tender work was invited in haste without understanding actual requirement of site and proper time required to procure all this was not given resulting in disputes in contract, blockage of money and even till date these consultants are trying to justify these unprofessional contracts.

A stage is reached in ERA where there is no body there who owns responsibility of floating unprofessional contracts resulting in everybody right from DSC, PMC & ERA passing buck on these issues and specially the engineers are dancing to the tune of the employers. They only do what they are told to do regardless of contract provisions.In the past few of them tried to speak against the tone of ERA officials,tried to raise voice against the bureaucratic approach were either thrown out or demobilized from the contract.

Nobody in ERA is adopting judicious approach to resolve these issues.If justice cannot be delivered within the organisation no court, no arbitration can understand the poor plight of the local/state contractor. It is necessary that somebody who really understands contract and contract management should listen to general grievances of a general contractor who are contributing majorly in state infrastructure by investing huge finance to take up development projects and save major exchequer losses in arbitration in future.ERA should also learn from past that  all these contract are based on FIDIC and attract escalation clause.Most of the contract has been awarded time extension resulting in 100% increase in escalation bill which is 8-10% of work done per annum whereas resolving disputes in these contracts will have less financial effect resulting in early completion and early benefit to the public by these projects.

Disposal Various meeting were held. Issues regarding forest clearances, Rates etc have been resolved as on date.
